Dvořák Hager & Partners succeeded in proceedings before the Supreme Administrative Court

Dvořák Hager & Partners successfully represented a fuel carrier in a dispute against the customs office regarding the forfeiture of 20,000 litres of diesel fuel. Compared to the existing judicial and customs decisions, we succeeded in convincing the Supreme Administrative Court that the Excise Tax Act and its requirements for the registration of transported fuels cannot be applied in a formalistic way, thus ensuring the return of the seized fuel to the client. Our support included representation of the client in the proceedings at the customs office and the General Directorate of Customs, and in the subsequent proceedings before the Regional Court and the Supreme Administrative Court.
