We are delighted to invite you to the CMS Lifesciences Business Breakfast, hosted by John Markham, Dóra Petrányi and Barbora Dubanská, our EU, competition and public procurement law specialists, on 15 November at CMS in Prague.
The Lifesciences sector has been facing increasing competition law enforcement, both from EU and national authorities and is subject to strict public procurement rules. Our competition law and public procurement specialists will talk about the EU and Czech legal background and present some recent case studies with practical guidance for pharmaceutical companies. We will focus on the following topics:
1. Competition issues
Market definition - relevance of demand-side substitution; relevance of the ATC classification in EU; narrow markets for generic products.
Stock allocation - circumstances in which dominant companies may ration supply; stock allocation policy in practice.
Generic competition - fall-out from the EU Sector Inquiry and current cases.
Pricing for dominant companies - abusive pricing rules; relevance of the major ECJ cases in 2012.
2. Do's and don'ts of communications - practical advice on what is allowed in interacting with other competitors and the public authorities.
3. Competition and public procurement issues under Czech law - Czech perspective on the competition issues and first practical experience with the reform of the public procurement with a special focus on the Lifesciences sector.
